1. Service Description
Opara AI (“we,” “us,” “our”) operates an AI-powered phone receptionist and messaging platform on behalf of skilled nursing and assisted living communities. When you call a business that uses our service, your call is handled by our AI receptionist. With your consent, we may also send you transactional SMS messages related to your inquiry.
2. SMS Messaging Terms
By providing verbal consent during a phone call to receive text messages, you agree to the following:
- You consent to receive transactional SMS messages related to your inquiry, including appointment confirmations, status updates, and follow-up information
- Message frequency is typically 1–3 messages per interaction
- Standard message and data rates may apply depending on your mobile carrier and plan
- You may opt out at any time by replying STOP to any message
- You may reply HELP to any message for support information
- Consent to receive SMS is not a condition of receiving service from the business you are calling. You may decline SMS and still complete your inquiry by phone
We do not send marketing, promotional, or advertising messages. All SMS communications are transactional and directly related to the inquiry initiated by you during a phone call.

3. Call Recording
Phone calls handled by our AI receptionist may be recorded for quality assurance and to verify consent. By continuing a call after being informed of recording, you consent to the recording of that call. Recordings are stored securely and retained in accordance with applicable law.
4. Disclaimers
Our services are provided “as is” and “as available” without warranty of any kind, express or implied. While we strive for accuracy, AI-generated responses may occasionally contain errors. Critical or time-sensitive matters should be confirmed directly with the business you are contacting.
5. Limitation of Liability
To the maximum extent permitted by law, Opara AI shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services, including but not limited to missed messages, service interruptions, or AI response inaccuracies.
6. HIPAA & Healthcare
If you are a healthcare provider or facility subject to the Health Insurance Portability and Accountability Act (HIPAA), you must execute a separate Business Associate Agreement (BAA) with Opara AI before using our services to process, store, or transmit any Protected Health Information (PHI). Our platform is not intended for use with PHI until a BAA is in place. Contact us to request a BAA.
7. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of Washington, United States, without regard to conflict of law principles.
8. Changes to These Terms
We may update these Terms of Service from time to time. Changes will be posted on this page with an updated effective date. Continued use of the service after changes constitutes acceptance of the updated terms.
